Falkon BioGreen Energy
Legal Notice and Terms of Use
1. About This Notice
This Legal Notice and Terms of Use (the "Notice") governs your access to and use of falkonbioenergy.com and its sub-pages (the "Website"), which is operated by Falkon BioGreen Energy Limited ("Falkon", "we", "us" or "our"), a company registered in the Masdar City Free Zone, Abu Dhabi, United Arab Emirates.
By accessing or using the Website you accept this Notice. If you do not accept it, please do not use the Website. This Notice should be read together with our Privacy Policy and our Cookies Policy.
2. Purpose of the Website
The Website is an informational site. It describes who Falkon is, the sectors in which it works and the type of projects it develops, and it provides a means of contacting us. It does not sell goods or services, does not create user accounts, and does not process payments.
3. No Offer and No Investment Solicitation
Nothing on the Website constitutes an offer, an invitation, a solicitation or a recommendation to buy, subscribe for or sell any security, share, interest, participation or financial instrument, nor to invest in or provide financing to Falkon or to any project described on it.
No information on the Website is a prospectus, an offering document, an information memorandum or a financial promotion, and it has not been reviewed, approved or registered by any securities regulator or financial services authority in any jurisdiction. The Website is not directed at any person in any jurisdiction where its publication or availability would be contrary to law or regulation.
Any discussion of a possible investment or financing with Falkon will take place separately, through documentation prepared for that purpose, with the parties concerned, and subject to the applicable legal requirements. Until such documentation is agreed and signed, nothing said on the Website or in preliminary contacts creates any binding commitment on either side.
4. Forward-Looking Statements and Project Information
The Website may describe projects, plans, capacities, timelines, technologies, markets and expected outcomes. Statements of this kind are forward-looking. They rest on assumptions, on information available at the time of publication and on conditions that are outside our control, including regulatory approvals, permits, feedstock availability, technology performance, construction and commissioning, counterparty decisions, commodity prices and financing.
Forward-looking statements are not promises, guarantees or projections of results, and actual outcomes may differ materially from them. Figures given for capacity, production, emissions, cost or schedule are indicative and subject to engineering studies, due diligence and definitive agreements. We are under no obligation to update any forward-looking statement after it is published.
A project described on the Website may be at an early or exploratory stage. Describing a project does not mean that it has been approved, financed, permitted or contracted, and it does not imply that any named third party has committed to it.
5. Sustainability and Environmental Statements
Where the Website refers to renewable, low-carbon, clean, green or sustainable characteristics of a fuel, a technology or a project, those references describe the intended design and objectives of the activity concerned, on the basis of recognised methodologies and of the information available to us at the time of publication. They are not certifications, and they do not by themselves establish compliance with any particular standard, taxonomy or labelling scheme. Where a certification, verification or accreditation exists, it will be identified expressly, together with the body that issued it.
6. No Professional Advice
The content of the Website is general information. It is not legal, financial, investment, tax, technical, engineering or environmental advice, and it must not be relied upon as a substitute for professional advice obtained for your own circumstances. Any decision you take on the basis of the Website is taken at your own risk.
7. Accuracy of the Information
We take reasonable care to ensure that the Website is accurate and current at the time of publication, but we give no warranty that it is complete, accurate, up to date or free from error. Content may be changed, corrected or removed at any time without notice. Where a document on the Website carries a date or version number, that is the reference point for the information it contains.
8. References to Third Parties
Any reference on the Website to a third party — including a company, institution, authority, project, technology, standard or location — is made for identification, context or illustration only. Unless we expressly state otherwise, such a reference does not imply any partnership, joint venture, agency, sponsorship, endorsement, approval or contractual relationship between Falkon and that third party, and does not imply that the third party has reviewed or agreed with what is published.
Statements published on the Website are made by Falkon in its own name and on its own account. They do not represent the views, positions or commitments of any employer, affiliate, shareholder or other organisation with which any of Falkon’s founders, officers, personnel or advisers may be associated in a separate capacity.
The Website may contain links to third-party websites and profiles. Those links are provided for convenience. We do not control, endorse or accept responsibility for the content, products, services or practices of any linked site, and following a link is at your own risk.
9. Intellectual Property
The Website and its content — including text, layout, graphics, diagrams, images, logos and the selection and arrangement of the material — belong to Falkon or to its licensors and are protected by intellectual property law. The name "Falkon", the Falkon BioGreen Energy Limited name and the Falkon logo are trade marks of Falkon, whether or not registered.
You may view the Website, and print or download extracts, for your own information or for an internal business purpose, provided that you do not alter the material and that you keep any notice of ownership intact. You may not otherwise reproduce, republish, distribute, sell, adapt or use the content commercially, nor use our name, trade marks or logo, without our prior written permission. Trade marks and names of third parties appearing on the Website belong to their respective owners.
10. Use of the Website
You agree to use the Website lawfully and not to:
- attempt to gain unauthorised access to the Website, its servers or any connected system;
- introduce malicious code, or otherwise interfere with the operation, security or availability of the Website;
- extract or harvest data from the Website by automated means, including scraping, except for ordinary search-engine indexing;
- use the contact form to send unsolicited advertising, spam, abusive content or anything unlawful; or
- misrepresent your identity or your authority to act for an organisation.
We may restrict or withdraw access to the Website where we reasonably believe that this Notice has been breached.
11. Material You Send Us
The contact form and our published e-mail address are open channels and are not secure. Please do not send confidential, proprietary or sensitive material through them. If you have a confidential matter, tell us that in general terms and we will agree a secure channel and, where appropriate, a confidentiality agreement before you send anything.
Material you send us on an unsolicited basis, and which is not covered by a confidentiality agreement signed by us, is received on a non-confidential basis. We assume no obligation to keep it confidential, to refrain from using ideas of a similar kind, or to compensate you for it, and we may already be working on, or may later independently develop, something similar. You confirm that you are entitled to send us any material you submit and that it does not infringe the rights of anyone else. Personal data contained in what you send us is handled as described in our Privacy Policy.
12. Availability of the Website
The Website is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, secure or free from error or from harmful components, and we may suspend, withdraw or restrict all or part of it at any time, including for maintenance. You are responsible for the security of your own device and connection.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Falkon, its officers, personnel and advisers exclude liability for any loss or damage arising out of or in connection with the use of, or the inability to use, the Website or reliance on its content, including loss of profit, loss of business, loss of opportunity, loss of data or any indirect or consequential loss, whether the claim is brought in contract, in tort or otherwise.
Nothing in this Notice excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.
14. Indemnity
You agree to indemnify Falkon against any loss, claim or expense arising from your breach of this Notice, from your misuse of the Website, or from material you send us that infringes the rights of a third party.
15. Privacy and Cookies
Personal data collected through the Website is handled as described in our Privacy Policy. The cookies and similar technologies used on the Website are described in our Cookies Policy. Those two documents form part of this Notice.
16. Changes to This Notice
We may amend this Notice at any time to reflect changes to the Website, to our activities or to applicable law. The version in force is the one published on this page, identified by its effective date and version number, and it applies to your use of the Website from the moment it is published.
Version history: Version 1.1 — 20 September 2026 — first publication. Version 1.2 — 28 September 2026 — company details updated following incorporation in the Masdar City Free Zone.
17. Governing Law and Jurisdiction
This Notice and any dispute arising out of or in connection with it or with the Website are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi, and the courts of Abu Dhabi have exclusive jurisdiction, without prejudice to any mandatory right a consumer may have to bring proceedings in, or to rely on the law of, his or her own country of residence. Where this Notice is made available in more than one language, the English version prevails in the event of any discrepancy.
